It’s often underestimated, but it’s critically important. We’re talking about creating a comprehensive inventory of *all* assets – real estate, bank accounts, investments, retirement plans, life insurance policies, personal property… everything. It’s not just about *what* you own, but also knowing where those assets are located and how they are titled. This stage also involves listing all liabilities – mortgages, loans, debts. You need a clear financial snapshot. Crucially, we also identify beneficiaries – who should receive what, and on what terms?

This isn’t simply a matter of filling out a form. It requires detective work, digging up old account statements, uncovering forgotten policies. Many clients are surprised at how much they’ve accumulated – or how outdated their beneficiary designations are! A common mistake is failing to update beneficiaries after a divorce or remarriage. Have you encountered any particularly challenging situations during this step, or perhaps stories that highlight the importance of thoroughness?

Oh, absolutely! We had a client, let’s call him Mr. Henderson, who was very meticulous about his finances. Or so he thought. During our initial assessment, we discovered he had a substantial amount of unclaimed funds in various state escheatment accounts. He’d completely forgotten about these funds – old savings bonds, unclaimed dividends, dormant checking accounts. It added up to over $15,000! It was a pleasant surprise for him, but it highlighted the importance of regularly reviewing your financial accounts and unclaimed property databases.

Then there was Mrs. Davies, who had a complex family situation – a blended family with children from a previous marriage. She had a will, but it was outdated and didn’t reflect her current wishes. About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
