Its purpose is to validate their will, identify and inventory their assets, pay any outstanding debts and taxes, and ultimately distribute the remaining property to their heirs according to the terms of the will or state law if there’s no will.

Think of it as a structured way to ensure everything is handled properly and fairly. Consequently, this process brings clarity and order during what can be a difficult time for families.

Focusing on Marshaling Estate Assets

Today we want to focus specifically on the step of “Marshaling Estate Assets.” Steve, can you walk us through what that entails?

Marshaling estate assets is a crucial stage where we thoroughly identify and document all of the deceased person’s possessions. This includes everything from bank accounts and real estate to personal belongings and investments. We then need to determine their current market value.

Ordinarily, this involves reviewing financial statements, property deeds, insurance policies, and other relevant documentation. It’s like putting together a complete financial puzzle of the person’s life. Moreover, we file an Inventory and Appraisal with the court, providing a detailed list of all assets and their estimated values.

I recall one instance where we were working on a case for a family who had lost their father unexpectedly. He was a meticulous record-keeper, which made our job much easier. We found neatly organized files containing account statements, stock certificates, and even a handwritten inventory of his personal belongings. It gave the family peace of mind knowing that everything was accounted for.

Conversely, I’ve also encountered cases where finding and valuing assets was incredibly challenging. In these situations, we might need to hire forensic accountants or appraisers to assist us. It’s a reminder that every probate case is unique and requires a tailored approach.

The Importance of Accurate Inventory

Steve, why is it so important to have an accurate inventory of estate assets?

Accuracy is paramount because the inventory serves as the foundation for the entire probate process. It determines how much money is available to pay debts and taxes, and ultimately, how the remaining assets will be divided among heirs. An incomplete or inaccurate inventory can lead to disputes, delays, and potentially costly legal battles down the line.

According to a study by the American Bar Association, approximately 25% of probate cases experience some level of delay due to issues with asset identification or valuation. This underscores the importance of working with an experienced attorney who understands the intricacies of this process.
