Welcome back to the show, folks! Today we’re joined by a true champion for our aging population, Frank Cook – an elder protection attorney right here in sunny San Diego. Frank, thanks for taking time out of your busy schedule.
What inspired you to focus on Elder Protection Law?
Well, it really comes down to wanting to make a difference. I’ve always been drawn to helping those who are vulnerable and need someone in their corner. When I saw the growing problem of elder abuse and exploitation, I knew I had to do something about it.
Many people may not even realize Elder Protection Law exists – can you give us a quick overview?
Absolutely! Elder protection law encompasses a wide range of legal services aimed at safeguarding seniors from various forms of harm. This includes financial exploitation, physical abuse, emotional neglect, and even self-neglect.
Could you walk us through one of the key steps in this process, like say… Protective Actions?
Let’s talk about protective actions, which often involve immediate steps to ensure an elder’s safety. Sometimes situations require urgent intervention. We might need to file for a restraining order if there’s a threat of violence. Or we could work with Adult Protective Services (APS) to investigate suspected abuse.
In some cases, seeking guardianship or conservatorship becomes necessary if the individual lacks the capacity to make safe decisions for themselves. This allows us to step in and manage their affairs, ensuring they receive proper care and protection.
- It’s crucial to remember that every case is unique, and we tailor our approach accordingly
- We always prioritize the elder’s wishes and dignity while taking swift action to mitigate any immediate threats.
“Frank truly saved my grandmother from a horrible situation. She was being financially exploited by someone she trusted, and he knew exactly how to handle it.” – Janice T., Point Loma
There have been times when securing the necessary protection has been challenging, for instance, I once represented an elderly woman who was living with her son. While there were signs of financial manipulation, proving it definitively was difficult. We had to be incredibly strategic and gather substantial evidence before we could intervene.
“I was overwhelmed dealing with my mother’s healthcare decisions after she became ill. Frank guided me through the legal complexities and helped ensure her wishes were respected.” – Michael S., La Jolla
