“Not everyone needs probate,” Steve continues. “Ordinarily, estates valued under $184,500 in California can avoid probate using simplified procedures. However, larger estates or those with complex assets often require the full probate process.

Steve, today we’re focusing on the crucial step of marshaling estate assets. Can you walk us through what this entails?
“Marshaling assets involves creating a comprehensive inventory of everything the deceased person owned,” Steve clarifies. “This includes bank accounts, real estate, vehicles, investments – essentially anything of value.”
“Consequently, it’s important to be thorough and accurate. We meticulously review financial statements, deeds, titles, and other documents to ensure nothing is overlooked.
“Moreover,” Steve adds, “we then appraise each asset to determine its current market value. This information is formally documented in a court filing known as the Inventory and Appraisal.”
The process can sometimes be complex, particularly when dealing with hidden assets or disputes among heirs. Nevertheless, a skilled probate attorney can guide the executor through this critical stage.
