Certainly. Handling debts and taxes is a critical step in ensuring the estate is properly settled. Ordinarily, after being appointed as executor or administrator by the court, we begin by identifying all outstanding debts of the deceased.

This can include credit card bills, loans, medical expenses, and utility bills. We then prioritize paying valid creditor claims according to California law. It’s important to note that not all debt is equal; some may be secured by assets while others are unsecured.

In addition to debts, we also address any taxes owed by the estate. This can involve federal estate taxes, as well as state inheritance or income taxes. Filing and paying these taxes accurately and on time is essential to avoid penalties and complications down the line.

Conversely, if the estate has insufficient assets to cover all debts, we may need to file a petition with the court seeking instructions on how to proceed. The court will ultimately determine which creditors are paid and in what order.

I remember one case where the deceased had accumulated a significant amount of credit card debt. Fortunately, through careful analysis and negotiation with the creditors, we were able to reach settlements that reduced the overall debt burden, ultimately allowing more assets to be distributed to the beneficiaries.

According to the California Courts website, approximately 70% of probate cases involve estates valued under $1 million. In these cases, federal estate taxes are typically not an issue. However, state inheritance and income taxes may still apply, depending on the specific circumstances.
