There are many reasons why someone might choose to establish a trust. One common reason is to avoid probate, which can be a lengthy and expensive legal process. A trust allows for the distribution of assets directly to beneficiaries without going through probate court.

That sounds very beneficial. Are there different types of trusts?
Steve Bliss:
Absolutely. California law recognizes several types, each designed for specific purposes. Tonight I’d like to discuss the Revocable Living Trust. This type allows the grantor to maintain control over their assets during their lifetime and make changes as needed. Ordinarily, it becomes irrevocable upon the grantor’s passing, ensuring a smooth transfer of assets to beneficiaries.
Consequently, a Revocable Living Trust offers both flexibility and peace of mind. The grantor retains complete access to and control over the assets while alive. Moreover, they can modify or even dissolve the trust as circumstances change. Nevertheless, upon their death, the trust automatically distributes assets according to the grantor’s wishes, bypassing probate and maintaining privacy.
The benefits are clear. I recall working with a client, Mrs. Rodriguez, who was deeply concerned about her children inheriting a large sum of money without proper guidance. A Revocable Living Trust allowed her to specify that the funds be distributed in installments over several years, ensuring responsible financial management by her heirs.
