Certainly. “Marshaling the estate assets” involves meticulously identifying and inventorying all of a decedent’s possessions. This includes everything from bank accounts and real estate to vehicles, personal belongings, and investments.
A detailed inventory is crucial for several reasons. First, it provides a clear picture of the estate’s overall value, which is necessary for determining whether probate is even required in the first place. Second, the inventory helps executors or administrators understand what assets need to be managed and distributed.
Ordinarily, this stage involves obtaining statements from financial institutions, appraising real estate and other valuable items, and locating important documents such as deeds, titles, and insurance policies.
Notwithstanding the meticulous nature of this process, I’ve encountered situations where heirs were unaware of certain assets belonging to their loved one. This highlights the importance of thorough communication with family members and a comprehensive search for any potential holdings.
Once all assets have been identified and valued, we file an Inventory and Appraisal (Forms DE-160/161) with the court. This document serves as a formal record of the estate’s assets and sets the stage for the subsequent steps in the probate process.

It can be emotionally taxing for heirs to sift through their loved one’s belongings. I recall one case where a client was overwhelmed with grief while going through her mother’s personal effects. Ultimately, completing the inventory brought a sense of closure for my client. She felt like she had honored her mother’s memory by carefully documenting and preserving her possessions.
