“And what if negotiations reach an impasse? What are the next steps?” I ask.

“If we find ourselves unable to agree on a settlement through direct negotiation, we may suggest mediation,” Mr. Morse replies. “This involves bringing in a neutral third party – a mediator – who helps facilitate discussions and guide us toward a mutually agreeable solution. While not always successful, mediation can be an effective way to avoid the time, expense, and uncertainty of going to trial.”

Mr. Morse recounts a case where negotiations stalled after the insurance company refused to cover the full extent of his client’s psychological trauma resulting from a serious car accident.
